Pitanga Terms of Use

These terms are the agreement between you and the people who make Pitanga. They cover the Pitanga, Combinado and Aventura apps and everything else at the same address. By signing in or creating your password, you accept these terms and the Privacy Policy.
Who provides the service
Pitanga is developed and run by Rodrigo Barbosa, an individual living in Canada. When these terms say "we", they mean him.
Who can use it
You must be 18 or older. Pitanga has intimate content for adults and is not made for minors.
Each account belongs to one person. You are responsible for keeping your password secret and for what happens in your account. If you think someone else got in, change your password (that signs out your other devices) and let us know.
For now, accounts are created by invitation. An invitation is personal and can't be passed on.
How a space for two works
In Pitanga, a space is always for two people. What you send or share in the space, the other person sees. Private choices — like your answers on the menu, your private notes and your own log — stay with you, as the Privacy Policy explains.
In Combinado, you choose who joins each space and who each list is shared with. Anyone with access to a list can see and change its items.
You can leave a space whenever you want; in Pitanga, either of you can close it. Some things that belong to both of you stay with the other person, as the Privacy Policy and the Delete account page explain.
Your content
What you write, record and send stays yours. For the app to work, you give us permission to store, process and show that content to the people you chose to share it with — and only for that. The permission ends when the content is deleted.
You may only send what you have the right to send. A photo or recording of someone else may only be sent with their consent.
We don't read, sell, or use your content for advertising or to train artificial intelligence.
What's not allowed
Sending any content involving minors, or intimate content of anyone without their consent.
Using the app to watch, pressure, threaten or control another person — including your partner. Pitanga exists so each person can say what they want freely; using it to take that freedom away breaks these terms.
Pretending to be someone else, trying to get into someone else's account, or trying to reach data that isn't yours.
Attacking, overloading or trying to get around the service's security, or copying the app or its content by automated means.
Using the app for anything illegal where you live.
What Pitanga is not
Pitanga is not therapy, couples counselling, or medical or psychological advice. Games, questions like On and Off and the log of how you are are there to talk and get to know each other, not to diagnose anything.
Pitanga is not an emergency service. If you or someone else is in danger, or if the relationship involves violence, contact the emergency or support services where you live (for example 911 in Canada and the United States, or 190 and 180 in Brazil).
Ideas suggested by artificial intelligence (such as "Create card") are drafts: check them before using them. What you type into those tools is sent to Google Gemini only to produce the suggestion.
The service
Pitanga is in testing. Features may change, improve or go away, and the service may be unavailable for a while. We make daily backups, but we recommend downloading a copy of your data if it matters to you (Settings → Download your data).
Suggestions and reports you send through Feedback may be used to improve the app, without creating any obligation or payment.
Plans and payments
Pitanga is free today. If there are paid plans, the price, how renewal works, cancellation and refunds will be shown clearly before any charge, and will become part of these terms.
In Brazil, you will have the right to cancel an online purchase within 7 days (article 49 of the Consumer Protection Code). In Canada and the United States, your province's or state's rules on cancellation and automatic renewal will apply.
Closing your account
You can delete your account at any time, from inside the app (see the Delete account page).
We may suspend or close an account that breaks these terms, especially if someone else is at risk. When it is possible and safe, we will tell you first and explain why.
Responsibility
We run Pitanga with care, but "as is": we can't promise it will work without interruptions or errors, nor answer for what people do with what they receive from each other.
To the extent the law allows, we are not liable for indirect damages or for data loss a backup would have prevented. Nothing in these terms limits the rights your country's law gives you as a consumer — in Brazil, those of the Consumer Protection Code.
Changes to these terms
If these terms change, the date at the top changes with them. Important changes are announced inside the app before they take effect, and you can delete your account if you don't agree with them.
Law and where to resolve problems
These terms are governed by the laws of the Province of Ontario and of Canada.
If you are a consumer in Brazil, Brazilian law also applies and you may bring any matter before the courts where you live. If you live in another Canadian province or in the United States, your province's or state's consumer protections still apply.
Before anything else, talk to us: most problems are solved with a conversation.
Languages
These terms exist in Portuguese and English, and both versions are equally valid.
